We anticipate last-minute changes, extensions, or cancellations of several COVID-19 related emergency laws and regulations previously enacted by Congress and state legislatures on these and other regulations:
Families First Coronavirus Response Act (FFCRA)
Dependent on Congress extending this emergency law, the Families First Coronavirus Response Act (FFCRA) paid leave requirements will expire on December 31st of this year. FFCRA requires certain employers to provide employees with paid sick leave or expanded family and medical leave for specified reasons related to COVID-19. The Department of Labor’s Wage and Hour Division (WHD) administers and enforces paid leave requirements.
I-9 Forms: Virtual I-9 Documentation Inspection
Employers hiring during the COVID-19 pandemic have until the end of the year to take advantage of relaxed document verification requirements for the Form I-9. United States Immigration and Customs Enforcement (ICE) extended interim policy allowing virtual inspection methods. This relaxed policy will expire on December 31st, 2020. Unless there is an extension of this temporary ruling, prior requirements for “in-person” verification of identity and employment eligibility documentation will resume.
